THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
About this notice
This Notice describes how ElizJoseph Healthcare LLC may use and disclose your health information, your rights concerning that information, and our responsibilities for protecting it.
ElizJoseph Healthcare LLC is required by law to protect the privacy and security of your Protected Health Information (PHI), provide you with this notice of our legal duties and privacy practices, and follow the notice currently in effect. PHI is health information about you that identifies you or could reasonably be used to identify you. It may be in paper, electronic, oral or another form.
This notice applies only to ElizJoseph Healthcare LLC and its applicable HIPAA-covered operations involving Medicare-Certified Home Health, including Skilled Nursing and Home Health Aide Services, Community Residential Services (CRS), and Integrated Community Supports (ICS).
Minnesota law may protect your health records more strictly than federal law. The Minnesota qualifications described below apply throughout this notice.
Your rights
Get an electronic or paper copy of your health record
You may ask to inspect or obtain an electronic or paper copy of health information that we maintain about you and that is available to you under applicable law. Ask us how to make a request.
We generally will provide access, a copy or a summary within the time required by applicable law. Minnesota law generally requires a provider to supply complete and current information it possesses about your diagnosis, treatment and prognosis in terms and language you can reasonably understand and, upon a written request, to provide copies within 30 calendar days, subject to lawful limitations.
We may charge only a fee permitted by applicable federal and Minnesota law. We will not charge a fee when you request records for the purpose of reviewing your current medical care, as provided by Minnesota law. If access is lawfully limited or denied, we will explain the decision and any available review rights.
Ask us to correct or amend your record
You may ask us to amend health information about you that you believe is incorrect or incomplete. Ask us how to make a request. We may deny the request when the law allows, but we will explain a denial in writing within the time required by law and describe any rights you have to submit a statement of disagreement or seek review.
Request confidential communications
You may ask us to contact you in a specific way or at a different location—for example, at a particular telephone number or mailing address. We will accommodate reasonable requests as required by law.
Ask us to limit what we use or disclose
You may ask us not to use or disclose certain health information for treatment, payment or health care operations. We generally are not required to agree, but if we agree, we will follow the restriction except where the law permits otherwise, such as when information is needed for emergency treatment.
If you pay for a health care item or service out of pocket in full, you may ask us not to disclose information about that item or service to your health plan for payment or health care operations. We will agree unless the law requires the disclosure.
Minnesota law may require your written permission for a disclosure even when HIPAA would otherwise permit it. We will follow the law that provides the greater applicable protection.
Get an accounting of disclosures
You may request an accounting of certain disclosures of your health information made during the six years before your request. The accounting does not include every disclosure; exclusions permitted by law include many disclosures for treatment, payment and health care operations and disclosures you asked us to make.
We will provide one accounting in a 12-month period without charge. We may charge a reasonable, cost-based fee permitted by law for an additional accounting during that period after telling you the cost and allowing you to withdraw or modify the request.
Get a copy of this notice
You may ask for a paper copy of this notice at any time, even if you agreed to receive it electronically. We will provide a paper copy promptly. When formally adopted, the current notice will also be available in an accessible electronic format through the ElizJoseph Healthcare LLC website.
Choose someone to act for you
A person who has legal authority to act for you, such as a legally authorized personal representative, may exercise applicable rights and make choices about your health information. We will verify the person's identity and authority before acting. The rights of minors, parents, guardians, health care agents and other representatives depend on the circumstances and applicable federal and Minnesota law.
File a privacy complaint
You may complain if you believe we violated your privacy rights. Contact:

Do not send protected health information through an ordinary public website channel. Staff will provide an appropriate internal form or secure submission instructions when needed.

We will not retaliate against you for exercising your privacy rights or filing a complaint.
Your choices
For certain health information, you may tell us your choices about what we disclose. If you have a clear preference in the situations below, tell us what you want us to do, and we will follow your instructions as required by applicable law.
You may choose whether we:
- disclose relevant information to family members, close friends or others involved in your care or payment for your care; or
- disclose information to assist in disaster-relief efforts.
If you cannot tell us your preference—for example, because you are unconscious—we may disclose relevant information if professional judgment and applicable law permit it and we believe the disclosure is in your best interest. We may also use or disclose information when permitted by law to prevent or lessen a serious and imminent threat to health or safety.
ElizJoseph Healthcare LLC does not maintain a HIPAA facility or patient directory.
Uses and disclosures requiring written authorization
We will obtain your written authorization for uses or disclosures that are not described in this notice unless the law permits or requires them without authorization.
Written authorization is generally required for:
- uses or disclosures for marketing that require HIPAA authorization;
- a sale of protected health information;
- most uses or disclosures of HIPAA-defined psychotherapy notes, if such notes exist; and
- other purposes for which applicable federal or Minnesota law requires written permission.
ElizJoseph Healthcare LLC does not currently use or disclose PHI for marketing requiring HIPAA authorization, receive payment for such marketing communications, sell PHI or receive direct or indirect remuneration for PHI disclosures, or create or maintain HIPAA-defined psychotherapy notes.
ElizJoseph Healthcare LLC does not use or disclose PHI for fundraising communications. Accordingly, this notice does not describe a current fundraising program or opt-out process.
If you give us written authorization, you may revoke it in writing as allowed by law. Revocation will not undo action already taken in reliance on a valid authorization.
How we typically use or disclose your health information
The examples below do not list every possible use or disclosure. In every case, we will use or disclose health information only as permitted or required by applicable federal and Minnesota law and will obtain your written permission when Minnesota law requires it.
Treatment
We may use your health information and disclose it to professionals and organizations involved in your treatment or services when applicable law permits.
Example: A nurse may disclose relevant information to an authorized practitioner or another treating provider to coordinate your plan of care.
Payment
We may use and disclose health information to bill for services and obtain payment from health plans or other responsible payers when applicable law permits.
Example: We may provide information needed by a health plan to determine eligibility, authorization or payment for covered services.
Health care operations
We may use and disclose health information to operate ElizJoseph Healthcare LLC, support quality and safety, coordinate services, train appropriate workforce members, conduct lawful compliance activities and improve care when applicable law permits.
Example: We may review health information to evaluate service quality or coordinate an individual's care and authorized supports.
Business associates
We may use contractors or service providers—called business associates—to perform functions or provide services on our behalf that involve protected health information. When required, we obtain written assurances that the business associate will safeguard the information and use or disclose it only as permitted by the agreement and law.
Other uses and disclosures permitted or required by law
We may use or disclose health information without your written authorization in the circumstances below only after satisfying all applicable legal requirements, including any more-protective Minnesota restriction.
Public health and safety
We may disclose health information for legally authorized public-health and safety activities, which may include:
- preventing or controlling disease;
- reporting adverse reactions, product defects or product recalls;
- reporting suspected abuse, neglect or domestic violence when the law permits or requires it; and
- preventing or reducing a serious and imminent threat to a person or the public.
Health oversight
We may disclose health information to legally authorized health-oversight agencies for activities such as audits, inspections, investigations, licensure, certification or other oversight authorized by law.
Complying with law
We will disclose health information when federal or Minnesota law requires it, including to the U.S. Department of Health and Human Services when necessary to determine our compliance with federal privacy law.
Workers' compensation
We may use or disclose health information as authorized by and to the extent necessary to comply with workers' compensation or similar laws.
Law enforcement and other government requests
We may disclose health information for a law-enforcement purpose or special government function only when the request and disclosure satisfy applicable federal and Minnesota law.
Judicial and administrative proceedings
We may disclose health information in response to a court or administrative order or another lawful legal process only when all applicable conditions are met. Minnesota consent and other more-protective restrictions continue to apply where applicable.
Coroners, medical examiners and funeral directors
We may disclose health information to a coroner, medical examiner or funeral director when a person dies and the disclosure is authorized by applicable law.
Organ and tissue donation
We may disclose health information to an organ-procurement organization or another entity involved in donation or transplantation when applicable law permits.
Research
ElizJoseph Healthcare LLC does not currently conduct or participate in research involving PHI. If that practice changes, we will revise this notice when required and will not use or disclose PHI for research unless all applicable federal and Minnesota requirements are satisfied.
Additional protections under Minnesota law
Minnesota law may provide greater privacy protection for your health records than federal law.
In general, ElizJoseph Healthcare LLC will not release your Minnesota health records to another person unless you or your legally authorized representative has signed and dated a consent authorizing the release, or the release is otherwise specifically permitted or required by Minnesota or federal law.
We will follow the law that provides the greater applicable protection.
A Minnesota consent is generally valid for one year unless the consent states a different period or Minnesota law provides otherwise.
Certain consents may remain valid until revoked when Minnesota law permits. You may revoke a consent as allowed by applicable law, but revocation will not undo action already taken in reliance on a valid consent.
Upon a written request, Minnesota law generally gives you the right to receive complete and current information we maintain about your diagnosis, treatment and prognosis in language you can reasonably understand.
You may also obtain copies of your health records within 30 calendar days, subject to limitations permitted by law. Any charge for copies will not exceed the amount allowed by applicable law. We will not charge a fee when you request records for the purpose of reviewing your current medical care.
Substance use disorder records protected by 42 CFR part 2
ElizJoseph Healthcare LLC does not operate an identified substance-use-disorder diagnosis, treatment or referral program subject to 42 CFR part 2.
To the extent we receive or maintain substance-use-disorder patient records protected by 42 CFR part 2, we will apply the additional protections required by that law. Such records, or testimony describing their contents, will not be used or disclosed in civil, criminal, administrative or legislative investigations or proceedings against the individual unless based on the individual's written consent or a court order entered after the individual or record holder receives notice and an opportunity to be heard, as required by Part 2. A court order authorizing use or disclosure must be accompanied by a subpoena or other legal requirement compelling disclosure before the requested record is used or disclosed.
We do not use PHI, including Part 2-protected information, for fundraising communications.
This conditional section does not state or imply that ElizJoseph Healthcare LLC operates a substance-use-disorder treatment program.
Our responsibilities
We are required by law to:
- maintain the privacy and security of your protected health information;
- give you this notice describing our legal duties and privacy practices;
- follow the duties and privacy practices described in the notice currently in effect;
- notify affected individuals promptly following a breach of unsecured protected health information as required by law; and
- use or disclose your health information only as described in this notice or otherwise permitted or required by law.
We will obtain written permission when required. If you give permission, you may revoke it in writing as allowed by law.
Changes to this notice
We reserve the right to change this notice and make the revised notice effective for health information we already maintain as well as information we receive in the future, as permitted by law. We will not implement a material change before the revised notice's effective date except when required by law.
When the notice is revised, the current version will be available upon request, at applicable service-delivery locations, and prominently on the ElizJoseph Healthcare LLC website. The controlled version formally adopted by Healthcare LLC must be used consistently for distribution and website publication.
